StoreFront Terms of Service

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING THIS WEB SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEB SITE. These terms of service ("Terms") apply solely to your access to, and use of, the Web site of StoreFront, also doing business as StoreFront by JesarArts, Inc, located at www.storefront.jesararts.net (the "Site") and the web design and hosting packages and services accessed through the Site as more fully described below (the "Services"). These Terms do not alter in any way the terms or conditions of any other agreement you may have with StoreFront, or its subsidiaries or affiliates, for products, services or otherwise. If you are using the Site or the Services on behalf of any entity, you represent and warrant that you are authorized to accept these Terms on such entity's behalf, and that such entity agrees to indemnify you and StoreFront for violations of these Terms. Nothing in these Terms shall be deemed to confer any third party rights or benefits. StoreFront may, at its sole discretion, revise the Terms, including any changes, at any time by updating this posting, with the revised Terms taking effect for all Users as of the date stated on the posting. You waive any right you may have to receive specific notice of such changes or modifications. Consequently, Users should consult the Terms regularly. Your continued use of this Site following the posting of changes or modifications will confirm your acceptance of such changes or modifications. If you do not agree to the amended terms, you must stop using the Site. 

Description of Services

"You" will hereafter be known referred to as the user/client. The Services include various online web site design and hosting packages operated and hosted by either StoreFront, or a StoreFront Affiliate, including but not limited to StoreFront's Yola Silver Account, Clients Personal Yola Silver Account, or StoreFront's Site5 Shared Web Hosting.
StoreFront sets out to create the client a professional website which is tailored to the client's requirements. 

Payment

Quotes provided by StoreFront are valid for a maximum of 14 days. On a client requesting a quote for a site and agree to the quote, the client will receive an invoice of 50% of the quoted amount, this is a non-refundable deposit on the development of a client's site and will be deducted from the total cost of the quote. Development on the client's site will only commence when StoreFront receives this initial deposit. When StoreFront deems that a clients site is completed an invoice of the remaining quoted amount. This must be paid within 14 days of the final invoice being sent to the client. Failure to do so will result in the clients site being unpublished from the www and will be deleted from StoreFront's database 60 days if final payment is not received within those 60 days.

Concerning StoreFront's Private Pro Package, this package MUST be ordered through the Private Pro Package link on our landing page under the slider heading "add-ons", this will direct the client to Yola.com where they can sign up for their own Yola Silver Package. It is advised that the client first informs StoreFront that they require the package before signing up for it through Yola. When signing up for your StoreFront Private Pro Package the URL that your browser is on MUST be: http://www.yola.com/lp/silver?cid=CJ20040 failure to sign up through this domain will result in a client ONLY receiving a Yola Silver Account and NO StoreFront Silver Package!

All StoreFront's Packages are provided on an annual cost. The client will be invoiced each year for the full amount of their initial quote, thus a client will pay the same amount for renewing their package as they did when purchasing it even if the purchase price has increased since the date they did.

User Sites

Packages including the Advanced and Pro Design and Hosting Packages do NOT provide clients direct access to their sites, all changes, updates or additions must be sent through StoreFront by correspondence. Packages including the Private Pro and Expert Design and Hosting Packages DO provide the client with direct access to their sites, all changes, updates or additions can be made by the client as well as the designer. It is however advised that changes made by the client are first approved by StoreFront unless such updates are designed specifically for the client, such as blog posts. All site design and hosting packages are limited as is indicated on that specific package. Please note that in server cases where StoreFront feels that a client has intentionally damaged the workings of site, will result in a cost for fixing the errors as well as a warning, consecutive incidents may result in a clients account being terminated as well as their site being shutdown however, all efforts will be made to insure the aforementioned client can retain their domain name.

Updating Sites

Apposed to our Expert and Private Pro Package, which allow the client to access their site directly to make alterations and updates. All other packages require the user to submit alterations and updates via correspondence to StoreFront. 

Migration of Sites or Packages


Once a client has a developed site on our; Advanced Package, they can upgrade this package, at any time, to our Pro Package, at an additional cost.

However, developed sites on either our; Advanced Package or Pro Package, cannot migrate to our; Private Pro Package or Expert Package. 

This rule can however be queried and if StoreFront decides that the migration is technically possible then the migration can be processed at an additional cost. This is currently due to a technical limitation with Yola. It is heavily advised that if a client may require direct access to their site to make updates or alterations personally that they rather choose to go with our Private Pro Package.

Neither may a developed site on our; Private Pro Package migrate to our; Expert Package or visa versa. This is due to Private Pro Package sites using Yola, whereas Expert Package sites use Wordpress.

All sites developed with Yola are PHP based and can be downloaded, and hosted by ones self.

Licence

All packages provided by StoreFront are provided on an annual development and maintenance charge. The client is not bound by any licence agreement and can terminate the service at anytime without any penalty fee. The Site and the StoreFront Theme are licensed from the owner StoreFront founder Jeremy Paton, subject to your acceptance of these Terms. Such license is subject to these Terms and does not include: (a) any resale or distribution of the Site or the StoreFront Theme; (b) modifying or otherwise making any derivative uses of the Site and the StoreFront Theme, or any portion thereof; (c) use of any data mining, robots or similar data gathering or extraction methods; (d) downloading (other than the page caching) of any portion of the Site or the StoreFront Theme except as expressly permitted on the Site; or (e) any use of the Site or the StoreFront Theme other than for its intended purpose. Any use of the Site or the Site Materials other than as specifically authorized herein, without the prior written permission of StoreFront, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time.


StoreFront reserves the right to modify, suspend or discontinue the Site or the Provided Services with or without notice at any time and without any liability to you.


You must be at least 13 years of age to create an account and to use the Services Provided. By registering, you represent and warrant to us that you are 13 years of age or over. Should StoreFront be notified or otherwise become aware that you are under 13 years of age, StoreFront reserves the right to terminate your account and this license and to refuse service to you at any time with or without notice.


StoreFront reserves the right to refuse service to anyone at any time with or without notice for any reason.


Cancellation

 

All our services are provided as a non-refundable annual cost. If a client wishes to cancel their package at any stage their is no penalty fee, however the client will not be refunded for the cost they paid for their package. Their package and site will be canceled the site will be "dormant" for a approximately 60 days before being deleted. The client can request for their site to be downloaded and sent to them or made available for download. However if the site makes use of the StoreFront Theme they have no legal right to continue to use it. The client however will keep their domain name.


If a client cancels their Private Pro Package, they will loose out on all support, site-design and maintenance provided by StoreFront. Their site will also be set to a default Yola Premium Theme and all content will be left in its current state. The client keeps their Yola Silver Account and can choose to continue working on their site personally.
